Usage Policy


I. Lawful Use

Winbeam 's Internet access services may be used only for lawful purposes. Transmission of any material in violation of any federal, state and local regulations is prohibited and will result in termination of services provided by Winbeam . Winbeam does not own or control many of the various networks, facilities, telecommunication lines, or computing resources to which it may provide access. Access to other networks through Winbeam must comply with the policies and restrictions of those networks. Reliance on or use of any information obtained from the Internet via Winbeam is at the users' own risk. Winbeam specifically denies responsibility for accuracy or quality of information obtained through its network.

II. Warranty/Limitations

Winbeam MAKES NO WARRANTIES EXPRESSED OR IMPLIED, including warranties of fitness for a particular purpose or merchantability. Winbeam makes no warranties to interruption of service due to circumstances beyond its control.

III. Billing Policies

"No Refund Policy". This policy affects all customers' accounts and will be enforced unless it is determined that a user is unable to access the Internet due to fault of Winbeam . In the latter case, Winbeam will refund or adjust the customer's account appropriately.

Returned checks and declined credit cards are subject to penalty charges.

All accounts will renew at the end of the billing cycle unless Winbeam receives notification to cancel from the customer listed on the account."

All requests for account cancellation will be finalized at month's end. Customers will have full access to e-mail and the Internet until termination at the end of the billing cycle. The billing cycle begins the first day of the month and ends the last day of the month. There will be no pro-rating of accounts.

Winbeam reserves the right to cancel any accounts that are delinquent in excess of thirty (30) days without prior notice.

All cancelled accounts may be subject to a reactivation fee.

When returning equipment, please make sure all original equipment is returned in good working order. Any equipment not returned or returned broken, will be charged to the credit card on file. If there is no credit card on file payment is expected within 15 days.

IV. Personal/Business Account Guidelines

Winbeam customers are required to be aware of and accept limitations and restrictions on computing resources as set forth in this Usage Policy.

Unlimited interactive personal/business use means that there is no additional charge for connect time. Personal and business dial-up accounts provide unlimited usage, not a dedicated connection. A dedicated connection is a constant connection in excess of eight (8) hours.

Automatic programs or "bots" that maintain an unattended connection are strictly prohibited. The hosting of HTTP, FTP, IRC or other servers are not permitted.

Accounts may be used either by a single person on multiple computers (for instance at home and at work) or by multiple users of the same machine. No simultaneous logins are permitted.

Unsolicited advertising, mass mailing and "spamming" are strictly prohibited.

The transmission of threatening, obscene, or harassing materials is unacceptable.

V. Conclusion

Customer is responsible for all actions and consequences incurred through use of the Internet. Customer agrees to indemnify and defend Winbeam for claims or charges resulting therefrom.

Winbeam reserves the right to monitor customers' actions to determine whether any of the aforementioned infractions have occurred. Winbeam will review violations on a case-by-case basis. Winbeam reserves the right to terminate any account at its sole discretion.

Winbeam reserves the right to amend this Usage Policy as it deems appropriate. It is the customer's responsibility to review this document from time to time.

This Usage Policy reflects the entire agreement between all parties and supersedes any prior oral or written agreements and understandings of the parties. This Usage Policy shall be governed and interpreted in accordance with the Laws of the State of Pennsylvania.
